Mass Tort Leads

Mass tort leads are inquiries from people who may meet the factual criteria associated with a large product-liability, pharmaceutical, environmental or other coordinated injury matter.

Compared with general personal-injury lead generation, mass-tort acquisition frequently uses campaign-specific screening and can involve high volumes of prospective claimants.

  • factual screening criteria
  • geography

  • exclusivity
  • whether the consumer was previously distributed

Those stages should never be collapsed into one vague term such as "qualified case."

Marketing Governance

Law firms should review the underlying ads and consumer journey.

ABA Model Rule 7.2 and its commentary allow payment for certain lead-generation services but distinguish generating leads from recommending a lawyer and place responsibility on lawyers to ensure related communications are consistent with professional rules. Jurisdiction-specific rules may impose additional requirements.

Screening criteria should be approved by the law firm and may involve relevant factual information about:

  • product/exposure
  • dates
  • geography
  • diagnosis or injury criteria where appropriate to the campaign
  • representation status
  • other matter-specific facts

Lead vendors should not independently give consumers legal conclusions.

Data Quality

High-volume campaigns make duplicate detection particularly important.

Evaluate:

  • duplicate rules
  • resubmission
  • data provenance
  • timestamp
  • consent/disclosure records
  • call recordings if applicable
  • source-level reporting

Economics

Measure the complete funnel:

media/lead cost → screened lead → completed intake → attorney review → retained claimant

A low front-end cost can be expensive if very few inquiries survive screening.

Choosing a Vendor

Require transparency about ads, landing pages, criteria, distribution, data controls, pricing and replacement terms.

Compare mass-tort lead providers based on campaign transparency, screening criteria, duplicate controls and retained-claimant economics.
